We are a hosting provider.

Under EU Regulation No. 2022/2065 on digital services (“DSA”), we are not directly liable for illegal content used, published, and disseminated by third parties through our hosting services. However, we do have an obligation (among others) to establish a mechanism for reporting illegal content and to set out conditions for restricting or removing objectionable hosted content.

Supervision of the fulfilment of our obligations in this area is carried out by the Czech Telecommunication Office.

What content can you report to us?

Content that violates legal regulations or constitutes unlawful activity. You can report objectionable content to us via this form.

How will we handle illegal content and your report?

If a user or third party violates legal regulations or our terms and conditions through our hosting, we may, at our discretion and depending on the degree of severity, suspend the display of such content, delete the content, or we may also suspend or even terminate the provision of our services if a user repeatedly or particularly seriously violates regulations, good morals, or our terms and conditions through them. In such a case, we will send all affected users a clear and specific justification for such an intervention.

We assess reported content without undue delay, individually, non-automatically, with the help of human review.

If you provide us with your electronic contact information (e-mail) in the report, we will send you confirmation without undue delay that we have received your report.

We will then also inform you of the resolution of the situation at the contact details you provided, and we will give you information about the available means of redress in connection with this decision.

Misuse of illegal content reporting

Please understand that the option to report content is not intended to “harass” users of our services or to resolve private-law disputes. Váš Hosting s.r.o. does not and must not substitute for any function of a “private arbiter”.

If you misuse our reporting system, we may, after prior warning, suspend your ability to use it and may also seek compensation for any damage you cause us through manifest abuse of the exercise of a right. Such damages may consist, for example, of costs we incur for legal consultations and representation.

When making decisions in these cases, we will take into account the number of items of manifestly illegal reported content or manifestly unfounded reports or complaints submitted over a certain period, their proportion in relation to the total number of pieces of information or reports, the intent, the seriousness of the misuse, the nature of the illegal content, and the consequences of such misuse.

We would also like to point out that we have no obligation to preventively monitor or check content in any way. Thank you for your understanding.
